Procurement for the public sector
Overview
Harper Macleod is known for its expertise in public procurement. We provide strategic and compliance advice to public sector clients in relation to procurement exercises including tender documentation and subsequent contracts as well as on competition law, potential TUPE application, poor supplier performance and advice on mitigation of risk of challenge, and how to respond to challenges.
We also regularly advise on joint procurement including availability of framework agreements and related procedures. We are increasingly being instructed by those seeking to challenge procurement decisions of public bodies and the team has particular experience of advising on public procurement issues relating to major sporting and cultural events organised by the public sector.
Our public procurement practice has developed a reputation for solution-focused advice, steering clients through the competition and subsidy control regulatory frameworks. Our solicitors have the necessary skills, knowledge and experience to lead on all legal aspects of significantly complex, high value and sensitive procurement matters for some of the biggest public sector organisations in Scotland.
